General Terms and Conditions of Sale
Article 1 - Seller and Scope of Application
The Website www.onedesign.bike is operated by PRINT S.r.l. Unipersonale, with registered office at Via M. Gandhi, 12 - 20851 Lissone (MB) - ITALY, VAT No. 00975260969, registered with the Monza Companies Register, hereinafter also referred to as the “Seller” or “Onedesign.bike”.
These General Terms and Conditions of Sale govern purchases of products made through the Website and form an integral part of the contract entered into between the Seller and the Customer.
Before submitting an order, the Customer is required to carefully read these General Terms and Conditions of Sale, the information relating to payment methods, delivery methods and shipping costs and, where applicable, the information regarding the right of withdrawal.
Article 2 - Consumers and Professional Customers
The Website allows purchases by Consumers and, where applicable, Professional Customers.
“Consumer” means a natural person acting for purposes outside their business, commercial, craft or professional activity. “Professional Customer” means a natural or legal person acting in the course of their business, commercial, craft or professional activity.
The provisions of these Terms and Conditions implementing mandatory protections under the Italian Consumer Code, including the right of withdrawal and the legal guarantee of conformity, apply exclusively to Consumers. Purchases made by Professional Customers are subject to the statutory provisions governing transactions between professionals, together with any specifically agreed conditions.
Article 3 - Products, Characteristics and Availability
The Customer may purchase the products listed in the Onedesign.bike online catalogue and available at the time of the order, as described on the relevant product pages.
Product information and images are provided for descriptive purposes. Photographs may show minor differences from the actual product, for example due to screen settings, aesthetic updates by the manufacturer or variations that do not affect the essential characteristics of the product. In all cases, the information concerning the main characteristics communicated to the Customer before purchase and the rights provided for by applicable law remain unaffected.
If, after an order has been submitted, one or more products are found to be wholly or partially unavailable, Onedesign.bike will promptly inform the Customer and, where payment has already been collected, will refund the amounts relating to the unavailable products, unless otherwise agreed with the Customer.
Article 4 - Prices, VAT and Other Tax Charges
Product prices are those shown on the Website at the time the order is submitted. The final amount is summarised in the cart and at checkout before the purchase is confirmed.
VAT treatment is determined according to applicable law, the destination country of the products and the type of Customer.
For sales to Consumers within the European Union, where required by the rules governing intra-EU distance sales, the Website applies the VAT due in the destination country. For Professional Customers identified for VAT purposes in another European Union Member State, the tax treatment is determined on the basis of the information provided, the validity of the EU VAT number and the fulfilment of any additional requirements laid down by law for intra-Community supplies.
For destinations outside the VAT territory of the European Union, customs formalities, import taxes, duties or other charges applicable in the destination country may apply. Where these amounts are not expressly included and shown at checkout, they may be charged to the recipient by the competent authorities or by the operators responsible for customs clearance.
Shipping costs charged to the Customer are ancillary to the sale of the products and, where required by applicable tax legislation, follow the VAT treatment of the main transaction.
Article 5 - Submission of the Order and Conclusion of the Contract
The presentation of products on the Website constitutes an invitation to make an offer to purchase and does not constitute an offer to the public.
By submitting an order, the Customer makes a contractual offer to the Seller to purchase the selected products and declares that they have reviewed the pre-contractual information and these General Terms and Conditions of Sale.
Before finally submitting the order, the Customer has the opportunity to review and correct the information entered, the billing and delivery addresses, the selected products, quantities, prices, shipping costs, applicable taxes and the total amount of the order.
The Seller may refuse incomplete orders, orders containing manifestly incorrect information, orders relating to unavailable products or orders that cannot be fulfilled for legitimate reasons. In such cases, the Customer will be informed without undue delay and any amounts already collected will be refunded.
The contract is concluded when the Customer receives the order confirmation from the Seller at the e-mail address provided during the purchase process. The confirmation contains a summary of the order and the relevant information concerning the contract, which the Customer can retain on a durable medium.
Article 6 - Payment Methods
Orders may be paid using the payment methods made available at checkout, currently bank transfer and credit card through Nexi's XPay platform, subject to any subsequent changes or additions communicated on the Website.
Operating conditions, bank details and further information concerning the payment systems are provided on the “Payment Methods” page, which forms an integral part of the information made available to the Customer before purchase.
Article 7 - Delivery Methods, Shipping Costs and Delivery Times
Deliveries are made to the destinations enabled on the Website and in accordance with the conditions set out on the “Delivery Methods and Shipping Costs” page.
Shipments are normally entrusted to Poste Italiane; Onedesign.bike may use a different carrier where necessary depending on the destination or specific delivery requirements.
Shipping costs, any thresholds for free shipping and the total amount payable are shown at checkout before the order is confirmed.
Unless a different delivery period has been agreed, delivery to Consumers will take place without undue delay and in any event within the period required by applicable law. Further conditions relating to delays, inspection of packages and acceptance subject to reservation are set out on the “Delivery Methods and Shipping Costs” page.
Article 8 - Invoicing and International Sales
The Customer is required to provide complete, accurate and up-to-date billing information. Professional Customers must provide, where applicable, their company or business name, VAT number and any additional tax information required by the system.
Tax documentation will be issued and transmitted in accordance with the procedures and in the cases required by applicable law.
Onedesign.bike also sells to foreign countries enabled at checkout. Delivery availability, shipping costs and VAT or customs treatment are determined according to the destination country and the type of Customer, as summarised before the order is confirmed.
Article 9 - Right of Withdrawal, Returns and Product Exchanges
Consumers are entitled to the right of withdrawal provided for by Articles 52 and following of the Italian Consumer Code, within the time limits and subject to the exceptions established by law.
The procedures for exercising the right of withdrawal, returning products, refund times and methods, the exclusions provided for by Article 59 of the Italian Consumer Code and any optional commercial product exchange service are described on the “Right of Withdrawal, Returns and Product Exchanges” page, which forms an integral part of these Terms and Conditions.
Article 10 - Legal Guarantee of Conformity
Purchases made by Consumers are covered by the legal guarantee of conformity provided for by Articles 128 and following of the Italian Consumer Code.
The Seller is liable to the Consumer for any lack of conformity existing at the time of delivery and becoming apparent within two years from delivery of the goods, in accordance with applicable law.
In the event of a lack of conformity, the Consumer is entitled to the remedies provided for by law, including, subject to the conditions and order established by the Italian Consumer Code, repair or replacement of the goods free of charge, a proportionate reduction in price or termination of the contract.
Any commercial warranties offered by the manufacturer are additional and do not replace or limit the legal guarantee owed by the Seller to the Consumer.
Professional Customers are subject to the statutory provisions governing transactions between professionals and any commercial warranties applicable to the product.
Article 11 - Approvals and Use of Products
Where a product is stated to be homologated or approved for road use, the relevant information is provided on the product page or in the manufacturer's documentation. Actual road use may depend on the type of vehicle, correct installation and the legislation in force in the country where the product is used.
The Customer is therefore required, before use, to verify that the product complies with the requirements applicable in their country and to their vehicle, including by consulting the competent authorities where necessary.
Products for which no road-use homologation or approval is indicated must be used exclusively in circumstances permitted by law, for example on closed circuits, in competitions, exhibitions or other contexts in which their use is legally permitted.
Article 12 - Compatibility, Descriptions and Liability
Onedesign.bike takes care to keep information concerning products, compatibility and applications shown on product pages up to date. If there is any doubt regarding compatibility with a specific motorcycle model or model year, the Customer is advised to contact Customer Service before purchasing.
To the extent permitted by law, the Seller shall not be liable for damage resulting from improper use, incorrect installation, use of the product contrary to the manufacturer's instructions or use in circumstances in which the product is not legally permitted.
Nothing in these Terms and Conditions excludes or limits the Seller's liability where such exclusion or limitation is not permitted by law, nor does it prejudice any mandatory rights granted to the Consumer.

Article 14 - Applicable Law, Dispute Resolution and Jurisdiction
These General Terms and Conditions of Sale are governed by Italian law, provided that, in relations with Consumers residing in another country, the choice of Italian law shall not deprive the Consumer of any mandatory protections granted by the law of the country in which they have their habitual residence, where applicable.
The parties may attempt to resolve any dispute amicably and, where applicable, may use alternative dispute resolution (ADR) mechanisms available under applicable law.
Disputes involving Consumers are subject to the mandatory rules on territorial jurisdiction and jurisdiction provided for by Italian and European law for the protection of Consumers.
For disputes involving Professional Customers, unless otherwise required by mandatory law or agreed in writing between the parties, the Court of Monza shall have exclusive jurisdiction.
